QUESTION

Do I have an assault case?

Asked on Jan 11th, 2014 on Criminal Law - South Carolina
More details to this question:
I went to a neighbor's home to discuss a drainage issue. Was invited in. Went to back of house to look. I explained the issue and asked if there was anything we could do. His reply: "No, I'm not digging up my yard." I calmly said there has been a natural culvert there since the neighborhood was built. He said he looked into it and legally doesn't have to do anything. I said, So you do whatever you want, doesn't matter how it affects your neighbors? He said he has a paper from the homeowner's association. I said, So you got permission? Just like you got permission to cut all of your trees down? He said he didn't need permission to cut the trees. I said he did, it was in our covenants. At that point he got loud, "Get out." I said, "Wait a minute. You invited me in. I'd like to resolve this." He screamed, "Get out!" I said, "You're an ass," turned around, and next thing I know I'm flying through the air. He had decked me from behind, down his eight front steps onto his walk and yard.

It definitely sounds like you have an assault case.  You should report it to the police immediately if you haven't already.  He should be arrested for assault and battery at the least.  If you incurred any medical bills, you may sue him in civil court for damages for the tort of assault as well.  While you should not have called him a name, it is not ok that he pushed you down the stairs.
