QUESTION

Do I have to do jail time?

Asked on May 14th, 2013 on DUI/DWI - Texas
More details to this question:
I have a current CDL. Before arrest, I went to hospital emergency and asked for help. The police were called. I was left alone and calmly walked out. I got in my car and drove past the police station knowing full well I would be pulled over. I was in crisis with extreme leg pain and fatigue, anxiety and depression. When out of the car, I told the officer I needed help and was treated with compassion and dignity and allowed to use my cane even at the station. I am under the care of health professionals and have been for some time.

Whether you will be sentenced to jail depends on your particular Court and assigned Judge, and the facts/circumstances of the incident, and your past criminal history. I would kindly but strongly recommend you consult with a local DUI attorney to present all your best arguments.

Hire a lawyer. You have not stated why you were arrested except to post under DUI. They have to prove that you were intoxicated by alcohol or drugs - not just tired or anxious.
