QUESTION

Do I need an attorney or can I plea this down myself?

Asked on Mar 21st, 2016 on Criminal Law - Tennessee
More details to this question:
Charged with identity theft (TN). It was an acct in deceased husband name. Under 200.00. Pd in full before arrest. Son made original complaint, state picked up charge. No clear victim. I draw disability and am not trying to get out of anything, please don't misunderstand. I simply want fair punishment. Can I plea down to a lesser charge with court cost and maybe probation?? I am willing to do whatever I need to do. It's more a matter of affording the fee that is more than deserved by any and all of you. Thank you in advance for your time and consideration.

You need to go to court and advise the judge that you can not afford an attorney and he will appoint one for you. With an attorney you can possibly get diversion (probation with expungement) with the worse that will happen you will get probation. Ask your court appointed attorney what diversion is and (s)he will explain it to you.
