QUESTION

do they present all charges in the police report?

Asked on Oct 12th, 2015 on Criminal Law - Texas
More details to this question:
I was recently charged with possession of marijauna under 2 oz, which in the state of Texas is a class b misdemeanor. When I was arrested, a portable vapor pen used for smoking marijuana was found. The cop asked me several times if it was used for marijuana concentrates-i informed him that it was just a smoking device. He told me they would send it off to be tested, and that was basically the end of that. I just received the police report, but it made no mention of the vapor pen, or sending anything off to be tested.my question is, is it common for them to mention thst on the police report, or do they not mention that on the report? I just wanted to be proactive and find out if I need to seek legal council, or just wait and see if they did.thank you for your time

The pen would be considered paraphernalia, which could get you a ticket for a Class C offense (Possessionof Drug Paraphernalia). It is conceivable that, once they determine it is an implement used for smoking pot, that you could have a citation issued to you through the mail. If that happens, go to court and ask for a deferred disposition. If they say no, hire an attorney. Your bigger concern is the Class B case.
