Do we need an attorney for my daughter's first offense marijuana possession charge?

More details to this question:
My daughter was arrested for marijuana possession. This was a first time offense, she was appointed a lawyer by the court.

Well you want an attorney that would be able to try and get her into a diversion program. Many courts have these for first time offenders. This sets it up so that she would not have a conviction on her record as a drug user.

If she was caught with a small amount of marijuana, her public defender should be able to reduce the charge to an Infraction. No need to spend money on an attorney to get you the same outcome.

If she was appointed a public defender, there is no need to hire an attorney. In Washington, a first time drug possession will result in having to take a drug and alcohol evaluation and complete any treatment prescribed, do community service, pay a fine, have no further criminal violations, and be on probation for one year. She will need to expunge her record after completion of probation.

It depends on whether or not you are happy with your court appointed attorney. If not, then hire private counsel to represent her.

I would meet with that attorney ahead of time, if possible. If after having spoken to that person, you feel comfortable with him/her handling the case, stay the course. If not, retain the services of an attorney. If you need an adjournment to seek out a new attorney, the judge will usually permit that.

In Missouri, the maximum penalty for misdemeanor marijuana possession (under 35 grams) is up to 1 year in jail and a fine of $1,000. If you don't feel comfortable with the court-appointed lawyer, hire a private attorney.
