Does my friend have a warrant for his arrest?

More details to this question:
My best friend already has to previous DUI's (Both charged as 1st offense). He went out drinking 1 night and was ordered to pull over but did not. He ended up totaling his car and taken to the hospital. When he woke up in the hospital, he said there were no police officers around and was also NOT handcuffed to the bed. Well he got up, got dressed and just left the hospital. His father had told me that after he had left the hospital, an officer called and said that after the hospital was going to release him that they were going to arrest him and charge him. So I guess my question is, does he or will he have a warrant for his arrest? Would those be misdemeanors or felonies? Is there statute of limitations on these? How much jail time could he serve if charged?

In Michigan, a third OUIL is a felony that carries up to 5 years in prison. Yes they can get a warrant for him(and probably will).

He needs to hire a lawyer before he talk to police investigators and incriminate himself. Tread lightly, because everything he does from this point forward will impact his case greatly.

The devil will be in the details and therefore a specific answer your question is impossible. It sounds as if the charge could be a third DUI which in the state of Michigan is a felony. The fact that he left the hospital will not change the fact that he will most probably be charged for a number of things.

While your friend doesn't appear to have been under arrest at the time he departed the hospital, he should seek out counsel at his first opportunity. he is almost certain to face charges of eluding and a felony DUI offense. the sooner he obtains counsel the better he will likely fare.
