I was arrested for a DWI and a resisting arrest charge. The resisting arrest was later downgraded to a disorderly persons charge before trial. I was later convicted of a municipal ordinance noise violation. Does the arresting officer need to review and approve my request for expungement? She was extremely rude and belligerent in the courtroom - yelling at my attorney. I am concerned she may still be vindictive. Also, I applied for a gun permit recently and was denied (in court) due to the resisting arrest and dwi. Will this affect my chance of getting the expungement?

the DWI cannot be expunged. the arrest and/or conviction for 'resisting arrest' can be expunged. the arresting officer has no input in the expungement process. the cost for the expungement is $1250. please call if we can help. ed dimon, esq. 732-797-1600
