Firearms issue

More details to this question:
My fiancée had an active pfa this past December and it was up in January, he forgot he even had it and went to purchase a firearm for xmas and answered the restraining order question as no, not thinking, completely accidental and just now the state police called him asking him why he answered no and he told them because he honestly forgot about it and they said they will have to talk to the DA to see if they want to press charges. If he did not do this intentionally and he is not a felon can they arrest him? Also, the pfa stated he could still carry firearms because of his military career.

This is a crime. I've seen many people who made this honest mistake sentenced to probation as a result.
