QUESTION

Has my case passed the Statutes of limitations?

Asked on Mar 13th, 2015 on Drug Crimes - New Jersey
More details to this question:
3 years ago I was pulled over by a NJ trooper. He stated that my vehicle was loud as his reason. He stated that he smelled Marijuana smoke. He asked me to step out of the vehicle and proceeded to search. He found a bag of less than 50g. I was accused of being in possession and was given a court date in Sept. 2012. They said that they would contact me for another court date after my appearance at the aforementioned date. It has been almost 3 years, and now they are calling me in to face the accusations. NJ State Statutes of Limitations law CODE 2c:1-6 states that an individual can not be charged with a misdemeanor past 1 year. Does this pertain to my case?

You raise a rather intersting question concerning the statute of limitations.  However, it depends on eaxctly how you were charged.  In order to better answer your question, I would need to know the exact qunatity that the summons-complaint states you were in possession of and the statute in which you were charged under.  If you can provide that information, I can better answer your question.
