QUESTION

How can I be tried for something I was never charged for?

Asked on Jul 12th, 2012 on DUI/DWI - New York
More details to this question:
I have been arrested for what I thought was DWI. I did have a prior conviction in 2002, and just got one again on April 15th of 2012. When I was arrested by the officer he had told me I missed the felony by a month, which he wrote on my police report the date of 3/09/2002. Then I walked into court this morning to find out I am being tryed for a felony DWI. So I guess my question is how can they try me for something I was never charged for. My tickets show its a first offense.

Just because the cops said that does not make him correct. The district attorney has the final say on the charges and ungraded.
