How can I charge a guy for statutory rape?

More details to this question:
Earlier this year my 16 yr old daughter was dating a 26 yr old guy. I never knew and when I found out, he was in jail. He will be there until Jan 2013, and when he gets out my daughter who thinks she's in love wants to move in with him. How can I get this guy for statutory rape and keep him in jail longer? Please help, I heard this guy is really bad news and my daughter has plans to become a doctor. I'm certain this guy will ruin her life. He is a known drug dealer. Please help.

You must teach your children to be good decision makers since you cannot always be there to help to make those choices. If he had intercourse with her it is statutory rape and you can go to the local police station and ask them to arrest him, even if he is already in jail.

All you can do is report the crime to law enforcement. They will investigate and turn the case over to the DA, who will decide whether or not to prosecute.

Report you suspicions to the police and have them talk to your daughter. Without proof(i.e. your daughter's testimony) they won't be able to do anything.

The only thing you can do is file a complaint with the local police department. The biggest issue will be whether or not they can prove sexual intercourse between them. It is not a crime for a 26 yr old to "date" a 16 year old as long as there was not sexual contact. You and the police may need your daughter's help to prove a statutory rape, which from your email, does not seem likely.

You need to file a report with law enforcement. They will conduct an investigation; if they determine there is enough evidence they will forward it to the county attorney for review.
