My daughter has felony, its deferred with 10 years probation, she has completed 3 years and is prompt with her payments and community service. She was a minor when this occurred and was sentenced as an adult. She is having a lot of difficulty getting a job because of this. What can I do as a parent to help her out? Can I hire an attorney and try to get her off early so she can go on with her life and try to get a career? How can I get this wiped off completely?
An early discharge is possible. There is no way to get the case to be expunged unless there is the case can be reopened through a Writ of Habeas Corpus, retried and she is found not guilty. If she received a deferred probation she may be eligible for a Non-Disclosure Order after the passage of five years from the end of the probation.
Get the lawyer to try a motion for early termination. It's doubtful after only 3 years, but you can try. Otherwise, she's on it until they allow her off it.
