QUESTION

How can I have my DUI expunged?

Asked on Jan 21st, 2014 on DUI/DWI - Michigan
More details to this question:
I got charged with an OWI at the age of 22 in 2011. I am now 25. Is there any way of getting this expunged or cleaned off my record? I graduated college and I do not want to have to list an OWI on my applications for work, especially ones that require a clean driving record. There has got to be some way to beat the system, especially since I do not put myself in such activities anymore.

In most States DUIs are NOT expugnable. Usually any crime involving driving is not expugnable.

There is no mechanism in Michigan to have an OWI conviction expunged from your Master Driving Record. In fact, by statute, there is no way to have ANY driving related conviction (e.g. speeding ticket, disobey stop sign, OWI, etc.) whether it is a criminal conviction or not - removed. Sorry. FYI, even for those criminal matters that can be expunged, the minimum waiting period before you can request expungement is 5 years. Good luck.

Not in Michigan, you cannot expunge traffic records (or generally beat the system).

Sorry, there is no way to expunge a drunk driving offense. They really stay on your record for life. That is because if someone receives 3 convictions in their lifetime, they can be charged with a felony.

The expungement statute specifically excludes drinking/driving offenses. The short answer is that there is no such thing. That said, if you can afford it and are willing to take the chance, you can hire us to move to set aside your conviction. We would have to order and pour over your court transcripts to discover a basis for setting it aside. If the court grants that, you will get a new trial. At the new trial, you might win. The officer might have retired or may not remember what happened these years ago. Or, you could get convicted again. That is really your only option. People don't do it that much because it is expensive and iffy.

In Michigan, unfortunately, any offense under the Motor Vehicle Code, including drunk driving, cannot be expunged. It will be on your criminal history and driving record for forever.

I am sorry to tell you that offenses that are listed under the Motor Vehicle Code, like DUI's, can NOT be expunged. Hopefully, they change the laws on that rule someday.
