More details to this question:
He has a drinking problem that he admits to and I know seeking help for. He was drunk the other night and hit me hard. We had a prior offense 7 years ago that we both got charged for. We have a six year old daughter together that loves us both very much. We also both work and have car payments. We both share with childcare. I work nights he works days. I called the police for help, not for total destruction of our lives. They are saying jail time, I would like to see probation and alcohol intervention.

If he was charged with a feeling domestic assault, he may have to spend some time incarcerated. If not, the police are mandated to detain him for 24 hrs, and he will be released on bail at arraignment. (So long as he is not a bail and/probation violator).
