QUESTION

How can I request alternative sentencing for a felony driving case?

Asked on Mar 08th, 2012 on Traffic Violations - Illinois
More details to this question:
Who do I contact about alternative sentencing in court or before my sentencing for felony traffic. My attorney advised my to take a plea and return to court for sentencing. She stated that the judge would not believe I was not driving because of my backround. There was never a traffic stop. The police came to my home and said that they saw my van going down the block and that I must have been driving. They wrote out a report and I was arrested in my own driveway and had to bailed out of jail. My girlfriend was driving but they would not listen and they told me to shut up and get in police car. My van was towed out of my driveway and now I am facing 30 days in jail. What can I do.

Please contact your attorney if you wish to withdraw your plea. Under Illinois law, you have 30 days to withdraw your plea of guilty after sentencing. It sounds like you agreed to a negotiated plea with a particular recommended sentence from the prosecution. Please contact your lawyer.   this posting is for informational purposes only and does not constitute legal advise nor the establishment of an attorney-client relationship.
