QUESTION

How can I restore my gun rights after taking probation and drug program (11351 HS possession)?

Asked on Oct 19th, 2012 on Expungements - California
More details to this question:
I got arrested for 11351 HS not for dealing, just possession, there was cocaine in my car and since I owned the car it was as good as mine. It wasn’t mine but I didn’t have money to hire a good attorney and fight it got stuck with the public pretender. He said it wouldn’t even show after because the case was going to be dismissed if the program was completed. I took a deal to do the program and probation and completed it the case was dismissed. I recently went to purchase a hunting rifle and was turned down CA DOJ said it was because I was placed on probation. Can I do anything to restore my gun rights?

Get a certified copy of the order of dismissal and mail it to the DOJ.

I think if you were convicted of a felony even though it went out with diversion and then the case was dismissed when you completed the program you are in the eyes of the DOJ and the Courts that you are a felon and con not own or possession a gun or ammunition for life.
