QUESTION

How can I visit my husband in jail?

Asked on Apr 20th, 2012 on Criminal Law - Rhode Island
More details to this question:
My husband is incarcerated in RI and is not eligible for parole for at least 14 years.. We were just married in the prison, but they are telling us because of my felony convictions that I will NEVER be allowed to visit him. Is there anything I can do to be able to get some kind of visitation? I have been complying with all aspects of my probation, graduated from an outpatient drug program, and I am working, trying to become " a productive member of society " .. All I want is to be able to see my husband, even if it has to be no contact visits or once a month, I just cant imagine not being able to see him for 14 years.. Any help would be greatly appreciated.. Thank you

Unfortunately, the Rhode Island rules are fairly clear; if you have a felony record, you may be precluded from visitation. To better answer your question, a qualified lawyer may review your particular record and determine whether the specific felonies that you have been convicted of are subject to denial of visitation. An appeal to the prison administration is also possible, however, rarely granted.

You have to be a family member and you need to request permission from the warden of the facility where your husband is housed.
