QUESTION

How can my friend appeal this case?

Asked on Dec 15th, 2012 on Criminal Law - Michigan
More details to this question:
My friend was sentenced with 10 years in federal prison, for conspiracy of armed robbery I think and, for using a gun, he never had the gun or was even involved with the robbery. He was threatened with a gun himself and was told to drive his car away from the crime. They charged him also for two other robberies that he wasn't even placed at.

Sounds like a nightmare. Consult with a good post-conviction/appeal attorney. Federal criminal appellate work is a specialized practice and only an handful of attorneys in each county are good at it.

It is possible to appeal but, without a great deal of additional information it is impossible to determine if there is any chance of winning.

Simple. Your friend needs a lawyer. Unless he waived his right to appeal (which only happens with some plea bargains) he is entitled to a court appointed lawyer to handle his appeal. Be aware that the timing of filing a notice of appeal is limited. All your friend needs to do is talk to the attorney that represented him in the trial court.

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. How long ago was he convicted? What evidence, if any, was presented against him and on his behalf? I strongly suggest that you or your friend contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your friend's case. He/she would then be in a better position to analyze his case and advise him of his options.

Well if he is innocent and went to trial then he has an absolute right to appeal the conviction. He should get an appellate attorney and fight.
