Asked on Apr 17th, 2013 on Expungements - Michigan
More details to this question:
I'm seeking information for my son to have charges "felony" expunged from his record so he can seek better jobs, and be more productive in society. Looking for information on how to go about it, and if we need a lawyer to hand it for him, and if there's a fee; and how much do it normally run to get done by a lawyer. If he can thank you for your time and attention P.S. It has be more than 10 years since his charge.

There are only a few types of felonies that can be expunged and only after 20 years of good behavior. You don't have to hire an attorney to file a petition for expungement, but I highly recommend it.

In Michigan, most felonies can be expunged after five years have passed since discharge from probation. There are exceptions to this so I would need to know what offense he was convicted of. Also, he cannot have other convictions on his record that took place after his 21st birthday. The process is fairly complicated and involves filing a petition with the court and submitting fingerprints, etc. to various state agencies.

In Nevada you are eligible to have your felony record sealed seven years after your release from prison or seven years after your release from probation, as long as you did not accumulate any additional charges during those seven years. There is a specific procedure for record sealing that involves getting a copy of your SCOPE from Metro and submitting documents to the District Attorney for review. The process generally takes at least ten weeks to complete. Although you can do it on your own, you are probably better off consulting with an attorney, who can complete the entire process for you.

It will depend on his full record as to whether or not he can have his conviction set aside or expunged. He would be best served to have an attorney assist him. The cost depends on the case and the time spent, but the first thing to do is to do the investigation necessary to see IF he qualifies under the statute. Have him call for an appointment.

What was your son's felony conviction for? Is it is only felony conviction? Does he have any misdemeanor convictions? If so, for what and how old was he when they occurred. Please feel free to call me with any questions you may have.
