QUESTION

How could I deal with a DUI from years back for which I do not finish classes?

Asked on Aug 14th, 2015 on DUI/DWI - California
More details to this question:
I got a DUI many years ago, about 11. I said I was guilty and paid a big fine and started traffic school. Before finishing my wife left me so I followed her to another state to try and win her back. That did not work out, but I got a great job in there so I never finished the program. Now I am back. What can I do to deal with this? Is there a chance I will go to jail? Thanks in advance for ANY advice!

If this was a first offence DUI in Wisconsin, no jail time attaches. Your best bet is to contact the lawyer who represented you during that case and ask him or her to contact the prosecutor and see if you can get back to the classes to finish things up. You could also notify the prosecutor yourself. If so, you would do well to check the State court database (in Wisconsin it is called CCAP or WCCA) to find out what, if anything, the Court did about your failing to complete the classes. Good Luck.

See an attorney. You need to address this and should be able to do so. Otherwise you may be subject to immediate arrest and punishment.

Chances are you have a warrant because you never finished your classes and are a fugitive. Since most DUIs are misdemeanors- your misdemeanor will be most dangerous to you in the county that your DUI was in. That's because the police in other counties don't have a big duty to transport you to another county over a misdemeanor. You probably cannot drive in California not until you finish that class. Sure, a fugitive could go to jail. You should hire an attorney. I charge $700 to go to court for you, recall your warrant, get you more time to finish your classes. Sometimes if it has been REALLY long, then you might actually not even be in the criminal system any more in which case you need to talk to the DMV to get those classes done - you will probably need your print out from the DMV to enroll in a class. Lookup your case online by doing a "case lookup Riverside county" type search in Google. That way you can find your case number etc. All in all, this might be a good time to get a lawyer!!

Most likely there is a warrant issued for your failure to complete the terms of your probation. Hire an attorney in the city where you were charged to see if a warrant has been issued and whether or not (s)he can have it recalled.

First things first. You should hire a lawyer to go to court to recall the warrant and get you re-enroll papers. A lawyer can do this without you present if the underlying charge is a misdemeanor, so it is less risky for you.
