It is a motion preceded by a bunch of other hoops. The key is qualifying. Only one crime ever, and more than 5 years passing.

First you must qualify. Must only have one criminal conviction on your record. Then ?must be at least 5 years since you completed contact with the DOC. Then go to Michigan State Police website for additional info on ordering your Criminal History. Better off to hire an attorney but this should get you most of the way.

Although you can seek a criminal impingement on your own, it is always best to seek the assistance of a criminal defense attorney who handles criminal expungement because they can be challenging and you want them done correctly. In Michigan, assuming you have no other criminal convictions other than the felony; the felony is not a conviction for criminal sexual conduct or a felony in which the maximum penalty is life in prison; no out of state convictions; no federal convictions; and it has been at least 5 years since the date of your conviction, then you can seek an impingement by completing an "Application To Set Aside A Conviction" with the court in which you were sentenced. You will have to notify the prosecutors office, Michigan Attorney General, Michigan State Police, and the Sentencing Judge of your intent to seek a criminal impingement. Typically, assuming all guidelines are met, your record will be expunged, but be mindful that this will always be at the discretion of the Judge and is not a guaranteed right to have your criminal conviction expunged.
