How do I get a case dismissed before retrial

More details to this question:
The case is a criminal theft case from 2011. It was tried in May of 2013 with a finding of not guilty for 3 charges and a hung jury for 2 charges. It is set to go to retrial soon. It is going onto the third year of this whol process. I have fulfilled every requirement requested. I am a good citizen in excellent standing and have never been in legal trouble or have a previous record.
