QUESTION

How do i get a shoplifting charge removed from my record? (CA)

More details to this question:
a year and 4 months ago I was arrested for shoplifting. (stupid, I know) it was a misdemeanor. Since then i have paid my restitution and been at my place of employment for a year. I want to know how easy or hard it would be to have it removed from my record. I have a few questions. 1. I was looking at expungement. Is this only for someone who commited the crime under 18? (i''m 19 now but i was 18 when i commited it.) 2. Is this a process i can file for on my own, or do i absolutely have to use a lawyer/expungement service? 3. If i was to resign from my place of employment, would it affect the courts decision on my appeal?

When you have completed probation you can file a 1203.4 motion with the court.  An attorney can help you with this, or you may be able to do it yourself.  Check with the court where you were convicted.  Your employment status will not likely be a factor in the court's decision.  If you have not been arrested since the conviction the court should grant your motion to dismiss under Section 1203.4 of the penal code, commonly known as an expungement.   Louis J.
