How do I get a WITHOUT PREJUDICE charge expunged from my record?

More details to this question:
I was charged in 2005 for something I didn't do. Spent 90 days in jail awaiting DNA results. The day the court was to read the results the charges were dismissed without reading. Now I can't get the arrest off my record because it was dismissed without prejudice.

You will probably need to file a motion to have that case expunged.  Typically you can get any number of dismissals expunged.  However, courts also usually require that you don't have any current criminal proceedings pending when you apply.  You should contact an attorney licensed in Kentucky to inquire further.   Simon W.
