How do I remove a drug charge?

More details to this question:
I was charged with stolen property and possession of illegal substances. I plead guilty to the drug charge to drop the stolen property charge and went to drug classes. I thought that the drug charge would also be dropped but when I got a background check recently for a job, they said I had a record. How do I get rid of it so that I might be able to pass a background check and get into the army?

You have to check with the State where this happened and see if you can expunge the conviction.

You can attempt to expunge it but you have to wait the statutory time period.

In Missouri, drug possession convictions are not eligible for expungement (removal) from your criminal record. If you had an SIS and were on probation for the drug charge, then if you didn't violate probation, there shouldn't be a conviction on your criminal record for the drug charge. You should call the court to check on what happened with your case.

You may, or may not, be able to expunge the case. If the two cases are intertwined, then you are not entitled to expunge the dismissed case. Consult with a local lawyer.

You should start by contacting the attorney that represented you originally. He or she will know the specific terms of the plea agreement that you entered into. It sounds like you may have been given drug diversion. If so, and provided that you successfully completed the program, then the case should not list as a conviction on your record. If you were not given drug diversion, then you were just given regular probation. If that is the case, then you can file a petition to dismiss the conviction under Penal Code section 1203.4. Again, contact the lawyer who represented you. If that's not possible, then consider hiring a local criminal defense lawyer to handle this.

Alabama does not have an expungement statute at this time, so there is no getting rid of it.
