QUESTION

How does a DUI appears if it occurs in a different state than the licensing state?

Asked on May 25th, 2012 on DUI/DWI - Texas
More details to this question:
If traffic offense occurred in Montana but the licensing state is Texas, what does this mean? Under the terms of the Plea Agreement, you would be convicted of a traffic offense (Operating a Motor Vehicle with a Blood Alcohol Concentration of .08% or greater/1st offense. This is not a criminal offense and would not constitute a criminal record. However, it is a traffic offense, lessor than the DUI/1st offense with which you have been charged. However, it is a drinking and driving offense and would appear on your traffic record and be reported your licensing state as a drinking and driving conviction

That's a weird Montana law and I don't know Montana law, but what I take from it is that they have something less than a DWI. So, even if they report it to Texas it won't satisfy as a prior DWI in Texas. And Texas will treat it the same as Montana. It may be on your record, but looks like it will just be on your driving record and not criminal record.
