QUESTION

How long can be held without being able to speak to an attorney?

Asked on Oct 22nd, 2016 on Criminal Law - Indiana
More details to this question:
My son was arrested for failure to appear from a case that was older than 10 years. It was about an apartment that he was a cosigner on. He is on house arrest. They arrested him and he went to court and was OR'd out but then his PO put a hold on him. We found out that he was also $593.00 behind on his house arrest fees. We left a message with his PO saying we could pay the fees that day but she wouldn't return our calls and she violated him. His case is in another county. Now he is being held and no one is telling him or us anything. Isn't he entitled to an attorney?

You ask two separate questions. Is he entitled to an attorney? Yes. Is there some sort of deadline before they get that attorney in front of your son to speak to? No. Appointed attorneys have time constraints like all other lawyers do. I would go pay the house arrest fees and hire an attorney for your son if I were you.
