How long can someone be held in jail without being charged with anything?

The inmates ex girlfriend accused him of rape. She refused the rape kit and also told them she no longer wants to press charges but now the state has picked up the case however there have been no charges bc there isn't any evidence bc the it was a lie. Can you please help?
