In Colorado, on a first offense DUI with a BAC under 0.20, then you more then likely would not face jail time. However, consulting with a DUI attorney in your area could provide additional information as to potential defenses and mitigating circumstances for your arrest. In addition to any court penalties, you may face suspension of your license and/or qualify for a restricted license through the DMV.

Well that depends on the judge and whatever other prior record (if any) that you might have.

It really depends on the jurisdiction. While jail for first time DUIs are still rare, they aren't quite as unheard of as they used to be. Jail is possible, but even when it is given for first offense, it usually ranges from 7-14 days. Probation is more likely.

In OK, a first offense is usually filed as a misdemeanor and punishable up to one year in prison. Prison time is not the normal punishment for a first time offense in OK however.

Jail should be the least of your concerns. A DUI results in loss of license, forced attendance in an expensive alcohol class, forced IID installation on your car, probation, a criminal record, a dinged-up credit, among other things. You need to hire a DUI specialist before you get duped into a plea that you will regret for life.
