QUESTION

How much trouble am I in exactly for being arrested for DUI?

Asked on Mar 31st, 2013 on DUI/DWI - Colorado
More details to this question:
Last night I was arrested for DUI. I was going the wrong way on an off ramp for the interstate and hit an oncoming vehicle. The police officer assured me that no one was injured. This is my first offense of anything. My driving record isn't the best, a few tickets. I was very compliant. I blew a .19.

Assuming that this is a first offense and truly no one was hurt (which seems unlikely since the accident would likely be a "head-on" collision) you are looking at a maximum sentence of 6 months in jail, if there were injuries you are looking at possible felony prosecution and significantly increased punishment. In addition to jail you are also facing a DUI program of up to 9 months, significant fines and fees and a license suspension for up to one year. You should contact a competent DUI lawyer within 10days of your arrest as you have important rights that vanish after that time.

Well you were drunk enough to be going the wrong way and you blew a high number. I would have you get into AA right away and get tested for alcohol abuse. Whatever the testing center says you should be doing for treatment, DO IT! These will help maximize any chance of avoiding or lessening a jail stay.

I am assuming that this is your first DUI. Usually there is a 4 to 6 months license suspension, but you may be eligible for a restricted license (to and from school and/or work). If your blood alcohol level is above .20 then there is a 10 month restriction, as well as other enhancements for excessive alcohol. There can also be enhancements for blood alcohol levels above .15 depending on the court and jurisdiction Fines from $390 to $1,000 plus penalty assessments and court costs which beings to the total to about $2,000.00. Your car may be impounded for up to 6 months. Up to 3 year optional ignition interlock device installed on your car. 96 hours to 6 months jail sentence, at least 48 hours of which must be continuance. However, the fact that you were involved in a crash may add additional jail time to the sentence.

It is a class A misdemeanor for which you could receive up to 1 year in jail and up to a $4,000 fine. You could also have your license suspended. You need to hire a lawyer immediately because you have limited time to request a hearing on your driver's license matter or your license will automatically be suspended. Also, your lawyer may want to use that hearing for discovery on the criminal case.

DUI and resulting convictions are serious and have many lasting consequences. From what you said, in Colorado, your license will be suspended, you would have to pay restitution, could face jail time, community service hours, and/or fines and fees. In addition you would be required to carrier SR 22 and install and ignition interlock in your car in order to reinstate driving privileges. You might want to consider retaining a local DUI attorney to represent and defend the charges against you.

It depends upon how you define "trouble". A DUI conviction is punishable by up to a year in jail and a $5,000.00 fine. Mandatory minimum penalty of a 1st time DUI with a BAC over .15 is as follows: 2 days in jail, minimum fine of roughly $1600.00; one year revocation of license; ignition interlock for one year (after your license has been reissued; SR22 high risk insurance; alcohol/drug treatment per the court.
