You have two choices. You can sue the person in civil court. You would be the plaintive. She would be the defendant. You would have the obligation of putting your case by a preponderance of the evidence. The second alternative is to bring the matter toCounty prosecutor and I have the county prosecutor bring an action against the person that stole your identity and stole your money. You would have less control in the criminal case because the prosecutor would be control of the case. In addition, the prosecutor would have to prove the case beyond a reasonable doubt. The criminal standard is much higher than the standard. You need to decide what you want to do. The cost for the civil matter ismuch greater because you're incurring the full cost for the attorney to bring the case on your behalf. The cost for the civil matter would be at least $7500. We could guide you through the criminal process for far less monies. The guidance of the criminal matter would be $2500. Please call to discuss.
