I am being prosecuted for theft from my job

More details to this question:
I had stolen 2 bottles of cologne from my job which totaled $150. In addition, I took $100 from the register and took an employees cell phone when i found it on the floor. I had returned the phone the following day along with the cologne and I paid back my job for taking the $100. What is the possibility of me going to jail for 6 months and/or getting a fine. I know the fine is $1000 and or max 6 months in jail. I have returned all the items and the money that was taken. This is my first offense. I do not have a record nor have been arrested.

the taking of the two bottles, the $100 and the cell phone is sufficient to prove the theft charges. the return of the items can be used to mitigate the consequences. the key is the position of the victim. if the victim wants you prosecuted, the prosecutor and judge will prosecute you. this can result in both a criminal record and jail time. ed dimon, esq. 732-797-1600
