Florida Title XLVII Chapter 934 requires all party consent for recording telephone calls. Federal law allows a business to record calls, (i.e. must announce at beginning of a call "this call is being recorded for quality, training, etc..). So...Does this announcement/exemption only protect the business? Or, can the calling customer also record (without further discussing it with whomever answers the phone)? If consent is required would the business and the person answering the phone be considered two separate parties. Would I need consent from the business, separately and apart from the consent of the person answering the phone? I interpret this announcement as: the business is recording, everyone who works for the business know the calls may/are being recorded, and I must assume the employees as a condition of employment have agreed to be recorded. So, since they are recording, I should also be allowed to record as well (without further announcement/discussion). Thanks
No, you may not record the phone call just because the business announced at the beginning of the call that it is recording. You have an option of terminating the call upon learning it is being recorded. If you also want to record the call, you must inform the person on the other end of the call before you begin recording so that party also has the option of hanging up rather than being recorded.
