QUESTION

I got charged with Misdemeanor Larceny under $200

Asked on Jun 26th, 2022 on Criminal Law - Michigan
More details to this question:
Basically, there was this event, a drag queen show, in a public square. I was there to protest the group sponsoring the event, not the drag queens themselves. When the show started, I placed my chair in front of the public stage and I sat in it with my sign. During the second performance, the dancer tried to grind on me so I got up from my chair. The dancer then sat in my chair and started throwing money in the air. When I turned around there was money on the ground everywhere so I walked to my chair and started picking up money off of the ground. The crowd became very angry, shouted "GET HIM!" so I started to run. A cop was also chasing me with the crowd and said "Don't touch him!" to the crowd. I was then placed under arrest for disturbing the peace. Later I was charged with Larceny. I was never asked or told to put the money down. I did not know that I was not allowed to take the money. The money was thrown into the air in a public space. I wouldn't have ran if I wasn't in fear.

Under Michigan law, applying the facts as your describe them, the larceny charge would not stand as you cannot be shown to have had the intent to steal. If someone throws money, they cannot say they don't expect others to pick it up. Sadly, the disturbing the peace charge will probably stand. The prosecution will be able to show you intended to interrupt the event and actually did disrupt the event. It is a misdemeanor, expect a fine and community service. It is best to consult with your court appointed attorney on this.
