QUESTION

If I am charged with DUI but refused all tests what should I do next?

Asked on Apr 28th, 2014 on DUI/DWI - Pennsylvania
More details to this question:
I was charged with DUI but refused to take a blood test. The officer has no evidence against me all he said was he smelled it on me. I took his sobriety test and didn't have any trouble but he still took me in and charged me with DUI. I signed the contract saying I know the implications of rejecting the blood test but I was not in the wrong and the officer has no sufficient evidence to prove other wise. Should I plead not guilty or try to get a plea bargain?

Be sure to hire a good lawyer.  The lawyer will use the Preliminary Hearing to determine whether the officer will testify that you actually failed the field sobriety tests even though you think you passed.  If he agrees that you passed then you may have a very good chance of winning your case, but my educated guess is that won't happen.  Then you need a lawyer to analyze all of the factors and defenses in your case and help you to make an informed decision about your next move.  Good luck.  Steve
