I have an ongoing civil case against my ex for paternity. She committed fraud and obstruction of justice in the first trial. We had to go to appeal court in order to overturn the lower court decision because of this. Yet she still continues to obstruct my civil paternity case for 3 years now. Should I wait until after my paternity is established before filing charges against her? I am worried that I may miss the time limit to file, which is 3 years from the time of commission of the crime.
You can't file a charge. Only the prosecutor can. You can report the information anytime you want. The longer you wait, the less likely it is that criminal charges will be brought.
