In Michigan, transporting alcohol or intoxicants in an open container is illegal; if charged and convicted, you may face criminal penalties. When a motorist is pulled over by law enforcement and found to have an open container containing alcohol, police will likely charge you with a misdemeanor offense. This depends, of course, on your criminal and driving history. The worse your record, the worse the potential punishment. It is important to note that this is the case even when the intoxicant was opened by another person and consumed by another person. As a driver, you are responsible for what happens in your vehicle.

The charge is called open intox in a vehicle and yes the driver will get in trouble also.

It depends upon a lot of factors. How old are the people in the car? What did they do they caused them to be stopped by the police.
