Is it easy to defend a .08 blood alcohol content? How?

More details to this question:
I have never been in trouble with the law for anything. I am a bartender and work late nights. I was charged with a DUI and they say that I had a .08 blood alcohol content. I was not even drunk at all! Since it is pretty low for a DUI, will it be easy to defend against this? Thank you.

All DUIs are hard. .08 should get a reduced offer, if you want a dismissal it will be a tough fight probably involving trial.

It will not be easy to defend. Bu you should consult a lawyer experienced in this area of law and who knows the practices of he local prosecutor and judges. Good Luck.

No, it will not be easy to defend this as, even if you could show that it .8 you were not impaired that level of alcohol in your blood is unlawful by statute. Therefore you could be found in not guilty of driving under the influence but guilty of driving with an unlawful blood alcohol level. Get yourself an attorney immediately.
