Is it illegal to sell a home that has bats in the attic?

More details to this question:
I bought a cottage. The homeowner knew it had bats in the attic. It did not state anything about infestation in disclosure. It only stated four days before closing that they may have a bat and they hired a company for an inspection but stated they couldn't make it out before the closing. We later found out, they did have the company out two weeks prior to this statement. Now we are incurring significant costs in removing and repairing the cottage. Upwards of $25000.00.

Sound more like a civil case to undo the sale or money damages for nondisclosure of material defect. But didn't you do an inspection before purchase? Surely, you would have noticed the infestation even without special training. Good luck convincing a prosecutor to get involved pursuing a fraud case in a real estate dispute over a defect with partial disclosure.
