More details to this question:
My fiance bought a phone from someone months ago and we got pulled over and her asked for my phone (I was in the passenger side) the police then looked at the serial number and took it because they said it was obtained from a aggravated robbery. And they charged him for the crime. Can they do that?

Merely having possession of the phone is by no means enough evidence to establish probable cause for an indictment, even if the phone was stolen.  Your fiance needs to call a criminal defense lawyer who knows the area in which he is charged.  Many of us offer free consultations.  Call a few lawyers, then hire the one you trust.
