Is it legal for someone to refile a case that has already been dismissed?

More details to this question:
I had a case dismissed because the prosecutor can't produce a witness but he has now refiled the charges. Is this legal for him to do and is there anything I can do about it? I have gone through this case for a year and now and I am guessing will have to go through this again for another year?

Yes, there is nothing illegal about that.
