QUESTION

Is it possible for a dismissal or no jail time for second DUI with documented mental illness?

Asked on Apr 10th, 2017 on DUI/DWI - California
More details to this question:
I satisfactorily completed the sentence or probation of my first DUI from October 2011. On April 07, 2017 I was arrested for a second DUI. I submitted a blood sample to law enforcement; I don't know what my BAC was yet, but I estimate it to be over .20; I have not yet received any charges filed or a court date. My driver license was in good standing at time of the recent arrest, my auto registration and insurance were current, and there was no collision, no injuries. I have a long documented history of "major depressive disorder". I currently take medication and receive counseling for my illness. I also suspect that a recent med adjustment ordered by my physician may have contributed to aggravating my mental condition just before the recent arrest.
