QUESTION

Is it possible to do a continuance for my hearing?

Asked on Jan 26th, 2013 on Criminal Law - Georgia
More details to this question:
I have my preliminary hearing on Monday January 28th, but due to unforeseen circumstances, I lost my representation and I am walking into my hearing on Monday blindly. I am up against some serious felony charges and do not want to take a chance on not making the best decisions possible.

Your lawyer will be there unless the court has allowed the lawyer to withdraw. If the lawyer withdraws, you will be given time to hire another lawyer.

You will need to request an adjournment from the court on Monday. Tell the judge the situation and ask for the prelim exam to be put off. You will probably need to waive your right to have the prelim exam held within 14 days of your arraignment (if you haven't already done so.) It is OK to do that. Just be sure not to waive the exam completely.

Explain to the Judge that you lost your attorney and that you need time to hire another one. ask for at least a month and set a pre-trial date before your preliminary hearing so that your new attorney can get the discovery and get up to speed.
