QUESTION

Is it possible to expunge the DUI record?

Asked on May 11th, 2013 on DUI/DWI - California
More details to this question:
A few years ago, I was arrested for an out of state DUI, in the name of closing the case I was offered a deal and I took it. I do not have a conviction but the arrest record bothers me. Is it possible to expunge the record? How long should, what expert should I reach out to. Has anyone ever road mapped such a thing?

Driving offenses are not expungable. You can't get them off your record.

No. You cannot expunge a DUI which is why it's so important to make sure you clearly understand your options.

In California, DUIs remain on your DMV record for 10 years and cannot be expunged from your DMV record. The DUI convictions may be expunged from the court records, at the discretion of a judge, but can still be used as enhancements for future DUI filings and convictions.

You cannot expunge arrests in California only convictions.

You need to consult a lawyer in the state where you were arrested for OWI (= DUI). Different states have different laws and practices relating to expungement. In Wisconsin you could probably not get the arrest record expunged, but there are (rare) exceptions to almost everything.

As long as you've successfully completed probation, you may be eligible.
