QUESTION

Is it possible to have my classes/community service transferred to another state?

Asked on Jan 17th, 2013 on DUI/DWI - Texas
More details to this question:
I received a DUI in CA and have already gone to court for it. I was sentenced to six months DUI classes, and community service, as well as a breathalyzer for four months. I have received a great job offer in TX and I would love to take it. I am on unsupervised probation, I do not report to anyone.

CA DMV generally accepts no other state's classes. You can contact them and see if you can get a special waiver and approval for classes in the other state. You'll have to do the community service here, unless you return to court and obtain a court ordered change of probation terms to allow it elsewhere. If you decide to hire counsel for that, contact me. You can move out of state unless your sentencing and probation terms specifically prohibit it.

No. The program has to be licensed in California. If you are leaving for more than 3 years the dmv will excuse the program, if you come back you will have to attend. It is up to the judge whether you can do the community service outside of the state.

I don't know CA law, but ask your probation officer if you can transfer it. Otherwise I can't legally tell you to go to Texas. You need permission.
