Is there a statue of limitations on felony DUI?

More details to this question:
Itโ€™s been 2 years going on 3 that my friend had caused an accident. Charge was driving under the influence. Heโ€™s never been to court, arrested, or even had a warrant. A few months ago, he was arrested for something completely unrelated and they are just now bringing up the charges.

The Statute of Limitation on a felony is usually 3 years, so it looks like they just made it in time. However, depending on the facts of the case, there may be a way to have it dismissed. Your friend needs to consult with an experienced criminal/DUI attorney as soon as possible.

He needs to hire a lawyer and file what's called a "Serna" motion.
