QUESTION

Is there a way to prevent jail time?

Asked on Sep 09th, 2013 on Sex Crimes - Illinois
More details to this question:
I'm charged with a Class 4 Felony for a false report. What happened is, I added information to a serious abuse case to ensure my father got what he deserves, and then I realized it was wrong and admitted that part of it was incorrect. After this, I was pressured into saying ALL of it was false, which is not the truth. After this turnaround, the prosecutor was brutal. He hit me with 30 months probation, a felony, mental help and anger management and 8 consecutive weekends in jail (my lawyer knocked it down to that, the prosecutor wanted months). Is there any way I could fight this? I had a spotless record before this. The prosecutor stated, "I don't give a sh** what happened. It's cases like this that make other rape cases harder to win." He claims to have an issue with my family, and he constantly spoke with the opposing side. All interviews done by state police were "off the record" for any support I would have had. It's all VERY one-sided. Any opinions? I would appreciate it!

If you plead guilty and were sentenced to 8 consecutive weekeneds, then your only hope at this point is to file a motion to withdraw a guilty plea if you are within 30 days of your plea of guilt. If you have not plead guilty yet, you can plead not guilty and ask for a jury trial or a bench trial. You can also plead guilty and request the Judge to sentence you. However, what you should not be doing is posting confidential matters on the internet.  You have an attorney  You should consult with him for your best course of action.
