QUESTION

Is there a way to shorten my DUI Probation?

Asked on Jul 23rd, 2013 on DUI/DWI - California
More details to this question:
I've got the money to pay my fine. They said if I pay in full at court, most likely I will get only 6 months of probation. Well if I ask them for more community service, can that result in shortening it even further? I'm trying to get into the military. I'm going through ARD.

Have your attorney talk to the prosecutor and your recruiter. They may be able to get the judge to terminate your probation early.

Talk to the probation agent and that person can advise you best about this.

You may file a motion with the court to terminate probation early. If you have completed all classes, paid all fines and fees, the court may grant the request. Have information or the basic approval to enter the armed forces, but for this probation.

It is entirely up to the court. A probationary period for DUI is 5 years. The purpose of this probationary period is to ensure, more than anything else, that you have no future law violations. I doubt you will get it reduced. The only possible way is to file a motion before the judge who sentenced you.

Yes. If you have a good reason, like wanting to get into the military, you can file a motion with the court to terminate your probation early. Usually, you are going to want to have completed all the terms and conditions of your probation before you ask. Usually, judges will terminate early if you want to go into the military.

Have you already been sentenced? If all conditions are complete then ct can terminate early. There is a statute allowing it.

The standard sentence for DUI includes 3-5 years of probation. It is possible to shorten the probation sentence by filing a motion to terminate probation. In my experience, the prerequisite to terminating probation include the following: 1. Fulfill all conditions of probation. In a DUI this usually means pay the fine, do the classes and whatever community labor or service were imposed. 2. Wait for more than 1/2 of the probationary term to elapse. 3. Have a good reason. In this economy, its necessary to be off probation to get a good job or a promotion. Immigration needs are another good reason. After the motion is heard and granted, the defendant can move to dismiss the charges pursuant to Penal Code Section 1203.4.
