QUESTION

Is there any way I can receive an ACD or diversion?

Asked on Feb 15th, 2015 on Criminal Law - Minnesota
More details to this question:
I was arrested for shoplifting. I attempted to steal a pair of shoes and a shirt valued at around $120. I put on the shoes and replaced them with the ones I was wearing at the time. I then went into the dressing room with the shirt and put it on over the one I was wearing. I attempted to walk out wearing the clothes when I was apprehended by a Loss Prevention officer. I was put under a citizen’s arrest while I waited for the officer to fill out paperwork. I was then arrested by a police officer who read me my rights and whom I gave a statement to. The officer then let me go after giving me a citation. How do I proceed with these charges? I am looking for anyway to not have this go on my record.

It is possible to end up with a result that keeps this thing from going on your record. To try to achieve this, your best bet is to retain a criminal defense lawyer. We would take some proactive steps to help your position and then try to convince the prosecutor to give you a favorable deal.
