QUESTION

Is this harassment?

Asked on Jul 12th, 2013 on Criminal Law - California
More details to this question:
The father of my child is constantly threatening to have my child taken from me. He is calling me a lunatic, crazy, unfit mother and a druggie. He is talking about me to my son and telling my son he should live with him and not me and that soon he can decide who he wants to live with (my son is only 3). Having my son make up stories about my boyfriend hitting him, brainwashing him with ideas to make me look bad. Is this harassment?

Sounds more like a family law question than a criminal one. Harassment has to be a threat to kill or cause bodily harm. Find a family law lawyer and strike first. The first one to court in a case like this usually is in the superior position.

It is a reason to not let this person see the child. You should go to a lawyer and discuss all your rights as a mother and what can be done about this. I would need a lot more information in order to give more specific advice.

Yes. Sadly, he is really screwing up the child. I would suggest that you take him to family court.

It may not be harassment, but it sounds like you are being set up for a child custody battle. I strongly suggest that you contact an experienced family law attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.
